Welcome to Paintniques. By visiting our website, creating an account, making a purchase, submitting designs, or participating in our community in any way, you agree to these Terms of Service. Please read them carefully.

These terms apply to all visitors, buyers, artists, and anyone else who interacts with Paintniques (“the Site”). If you don’t agree with any part of these terms, please don’t use the Site.

01. About Paintniques

Paintniques is a US-based print-on-demand marketplace and creative community for DIY artists. We offer:

• Artist-designed decoupage paper (rice and tissue) produced through print-on-demand fulfillment
• Curated paint and supply partnerships
• Classes, workshops, and real-world events
• A creative community platform for DIY artists and makers

Paintniques and our community platform (currently hosted on SKOOL) is governed by both these Terms and the terms of that platform. These Terms apply to Paintniques only and does not include the artists featured on this platform.

02. Eligibility & Account Registration

To use Paintniques you must be at least 18 years of age and a legal resident of the United States. By using the Site you represent and warrant that you meet these requirements

Creating an account

Some features of Paintniques require an account. When you register you agree to:

• Provide accurate, current, and complete information
• Keep your password secure and not share account access
• Notify us immediately if you believe your account has been compromised
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, at our sole discretion, are harmful to the community.

03. Purchasing on Paintniques

Print-on-demand products

All products sold on Paintniques are made to order. When you place an order you are authorizing us to produce and ship that item specifically for you. Because of this:

• All sales are final except as outlined in our Return & Refund Policy
• Slight color variation between screen display and printed output is normal and not a defect
• Tissue and rice paper inks may vary between print runs, just as fabric dye lots vary — order matching designs together

Pricing & payment

• All prices are listed in US dollars
• We accept major credit cards and other payment methods displayed at checkout
• Paintniques reserves the right to change pricing at any time without notice — the price at checkout is the price you pay
• Sales tax is collected where required by law

Order acceptance

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order at our discretion, including for pricing errors or suspected fraud. If we cancel a confirmed order, you will receive a full refund.

Cancellations

Cancellations are only possible within 24 hours of purchase. After that window production has begun and cancellations cannot be accommodated. See our Return & Refund Policy for full details.

04. Artist Submissions & the Marketplace

Paintniques is a curated marketplace that includes both original designs and AI designs submitted by approved independent artists. This section applies to artists who apply to sell their work on Paintniques.

Application & approval

Selling on Paintniques requires an application and approval by The Curator. Acceptance is at Paintniques’ sole discretion. Approval to sell does not create an employment, partnership, or agency relationship between the artist and Paintniques.

Artist content license

By submitting designs to Paintniques, you grant Paintniques a non-exclusive, royalty-free, worldwide license to:

• Display, reproduce, and sell your designs on Paintniques products
• Use your designs in marketing, promotional, and community content related to Paintniques
• Resize, reformat, or adapt your designs as needed for print-on-demand production

You retain full ownership of your original artwork. Paintniques does not claim ownership of your designs. You may continue to use, license, or sell your designs elsewhere unless a separate written exclusivity agreement has been made.

Artist representations & warranties

By submitting designs, you represent and warrant that:

• You are the original creator of the work and own all rights to it
• Your designs do not infringe on any third-party copyright, trademark, or intellectual property
• Your designs do not contain defamatory, obscene, or unlawful content
• You have the right to grant the license described above

You are solely responsible for any claims arising from your designs. Paintniques reserves the right to remove any design at any time without notice.

Royalties

Approved artists earn a royalty on each sale of their designs. Royalty rates, payment schedules, and payment methods are detailed in your Artist Agreement, which supplements these Terms. In the event of a refund or order cancellation, royalties for that order may be reversed.

05. Community Standards

Paintniques is a place built on creativity, generosity, and belonging. Everyone in our community — buyers, artists, and visitors — is expected to uphold that spirit. By participating in any Paintniques community space (including SKOOL, social media, events, or any future platform), you agree not to:

• Harass, bully, threaten, or demean any community member
• Post or share content that is hateful, discriminatory, obscene, or unlawful
• Promote competing platforms or products in a way that is disruptive or spammy
• Share another person’s private information without their consent
• Impersonate Paintniques, or any other person or brand
• Use the community for unsolicited commercial promotion
• Engage in “product wars” or disparage other artists, brands, or products

We reserve the right to remove content, warn, suspend, or permanently ban any user who violates these standards — without notice and at our sole discretion. We want this to stay a place everyone is proud to be part of.

06. Intellectual Property

Paintniques content

All content on the Paintniques website — including the brand name, logo, site design, copy, photography, and any Kelly-original designs — is owned by or licensed to Paintniques and protected by US copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from any Paintniques content without express written permission.

Artist content

Individual artist designs displayed on Paintniques remain the intellectual property of their respective creators. Purchasing a product does not transfer any design rights to the buyer. You may not reproduce, resell, or commercialize any artist’s design in any form.

User-submitted content

If you share photos, reviews, or other content on Paintniques platforms or tag us on social media, you grant Paintniques a non-exclusive, royalty-free license to share and feature that content for community and promotional purposes. We will always credit creators when we share their work.

Reporting infringement

If you believe any content on Paintniques infringes your intellectual property rights, please contact us at create@paintniques.com with details of your claim. We take IP concerns seriously and will investigate promptly.

07. Classes, Events & Future Membership

Classes & events

Paintniques hosts paid and free classes, workshops, and events. When you register for a paid class or event:

• Payment is due at registration
• Cancellation and refund terms specific to each class or event will be stated at the time of purchase and supersede the general Return & Refund Policy for that purchase
• Paintniques reserves the right to cancel or reschedule events — registered participants will be notified and refunded if an event is cancelled by Paintniques

Future membership tiers

Paintniques may introduce paid membership or subscription tiers in the future. When that happens, specific terms — including billing, cancellation, and access — will be presented to you clearly before any charge is made and will be incorporated into these Terms by reference.

08. Affiliate & Partner Relationships

Paintniques maintains affiliate and partnership relationships with select paint and supply brands. We may earn compensation when you purchase through affiliate links. We only partner with brands we genuinely believe in and will always disclose affiliate relationships clearly, in compliance with FTC guidelines.

Affiliate or sponsored content does not influence our editorial recommendations or community standards.

09. Disclaimers & Limitation of Liability

As-is service

Paintniques and its products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent permitted by law, Paintniques, its owner, staff, artists, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, any products purchased, or any community interactions — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of Paintniques shall not exceed the amount you paid to Paintniques in the 90 days preceding the claim.

Third-party links & platforms

Paintniques may link to third-party websites, platforms, or services. We are not responsible for the content, privacy practices, or terms of any third-party site. Links do not constitute endorsement.

10. Indemnification

You agree to indemnify, defend, and hold harmless Paintniques and its owner, artists, partners, and affiliates from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site or any products purchased
• Your violation of these Terms
• Any content you submit, including artist designs
• Your violation of any third-party rights

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and the state in which Paintniques is registered, without regard to conflict-of-law principles.

Informal resolution first

Before filing any formal claim, you agree to contact us at create@paintniques.com and give us a reasonable opportunity to resolve the issue. Most concerns can be handled quickly and directly — we genuinely want to make things right

Dispute resolution

Any dispute that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English in the United States. You waive any right to a jury trial or to participate in a class action lawsuit related to your use of Paintniques.

12. Changes to These Terms

We may update these Terms of Service from time to time as Paintniques grows and evolves. When we make material changes, we’ll let you know via email (if you’re subscribed) or with a notice on the Site. The “Last Updated” date at the top of this document always reflects the most recent revision.

Continuing to use Paintniques after updated Terms are posted means you accept the revised Terms. If you don’t agree with changes, you may close your account and stop using the Site.

13. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, Return & Refund Policy, and any Artist Agreement, constitute the entire agreement between you and Paintniques.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

Assignment. You may not assign your rights or obligations under these Terms without our written consent. Paintniques may assign its rights without restriction.
